LEGAL & PAYMENTS

TERMS & CONDITIONS

Clear terms.
Confident payments.

For the DRUMM8 app, drum lessons, student subscriptions, Payfast payments and EFT.

1. Using DRUMM8

DRUMM8 provides practice, education, creative, performance, tutoring and career-management tools for drummers. Use it lawfully, provide accurate information and do not disrupt, reverse engineer or misuse the service. Features and prices may change, but material changes affecting an active paid plan will be communicated before they take effect where required.

2. Plans, prices and recurring subscriptions

The plan name, price, billing interval, start date and included services shown before checkout form part of your agreement. Unless clearly described as fixed-term, a recurring subscription continues for each stated billing cycle until cancelled.

By choosing recurring payment, the account holder authorises Payfast to collect the displayed recurring amount using the selected payment method. DRUMM8 does not receive or store full card details. Any trial, joining fee, minimum commitment, lesson-expiry rule or special price must be stated before purchase. A plan does not guarantee a lesson time until the tutor confirms the booking.

3. Payfast online payments

Once-off online payments and subscriptions are processed securely by Payfast, an independent payment service provider. Payment is complete only after DRUMM8 receives reliable confirmation or verifies the transaction. A checkout screen, bank notification or pending status alone does not prove final settlement.

If an amount is debited but the invoice remains unpaid, contact support with the invoice reference. Never send a card number, CVV, online-banking password or one-time PIN.

4. EFT payments

Use the exact banking details and payment reference displayed in the student portal or invoice. Ordinary EFT payments are not automatic subscriptions. An invoice remains unpaid until cleared funds are visible and verified. Uploading proof starts a review but does not itself prove payment. Incorrect references can delay allocation.

5. Due dates and failed payments

Fees are due on the date shown. If a recurring payment fails, Payfast may retry it under its process. DRUMM8 may notify the payer and temporarily pause paid services or future bookings while an overdue amount remains unresolved. Amounts already due for services supplied remain payable.

6. Cancellation and subscription changes

Request cancellation through an available account control or by emailing support. For an ordinary month-to-month subscription, cancellation stops future recurring charges after the current paid billing period; submit the request before the next billing date. Cancellation does not automatically refund a completed billing period or lessons already supplied.

If a plan is a fixed-term consumer agreement, statutory cancellation and expiry rights apply, including 20 business days’ written notice where the Consumer Protection Act applies. Any permitted cancellation charge must be reasonable and amounts belonging to the consumer must be credited. Cancelling a Payfast recurring instruction does not erase unpaid invoices or amounts already due.

7. Refunds, credits and cooling-off rights

Send refund requests to support with the payer name, invoice number, payment date, amount and reason. Refunds are considered for duplicate or incorrect charges, unallocated payments, qualifying service failures and rights available under South African law. Lessons or subscription periods already supplied or used are generally not refundable unless the law requires otherwise.

Statutory cooling-off rights remain unaffected. Approved Payfast card refunds are returned through Payfast to the original card or payment route where required; cash refunds are not issued for card payments. Processing time depends on the provider and bank. A refund record will be issued or made available.

8. Lessons, rescheduling and no-shows

Lesson cancellation, rescheduling, late-arrival, missed-lesson or expiry rules displayed with the chosen plan apply in addition to these terms and must be communicated before purchase. Nothing limits a non-excludable consumer right or a remedy for a service not supplied with reasonable quality.

9. Receipts, disputes and chargebacks

Receipts are issued after payment is verified. Contact support first if a payment appears incorrect. A chargeback does not remove a valid obligation for services already supplied. Fraudulent payment claims, altered EFT proofs or unauthorised use may result in account suspension and referral to the relevant provider or authority.

10. Privacy and payment data

DRUMM8 records plan, invoice, payment-status and receipt information needed to administer lessons. Payfast processes online payment details under its own privacy and security terms. DRUMM8 does not receive or store full card numbers, CVV values or online-banking credentials. EFT proof files are stored privately until verified or deleted. Financial records may be retained for the period required by law.

11. Content, safety and availability

You retain ownership of content you create and must have the rights to material you upload. The service is provided as available and uninterrupted access is not guaranteed. Keep backups. Tempo, pitch, BPM and tuning results are guidance. Protect your hearing and stop if you experience pain, ringing or discomfort.

12. Liability, law and contact

To the extent allowed by law, Adriaan Cronjé is not liable for indirect loss, lost data, missed performances, equipment damage or third-party copyright claims. Rights that cannot lawfully be excluded remain unaffected. These terms are governed by South African law.
